The Business Law Group assisted in achieving a favorable 8-1 ruling at the U.S. Supreme Court in the case Badgerow v. Walters, No. 201143, S.Ct., 2022 WL 959675, at *4 (Mar. 31, 2022). The firm worked with Haynes and Boone, LLP Partner Daniel Geyser, chair of the firm's U.S. Supreme Court Practice, who argued the case on behalf of the petitioner, Denise Badgerow. The court sided with Badgerow in determining that federal courts do not have subject-matter jurisdiction to confirm or vacate arbitration awards under Sections 9 and 10 of the Federal Arbitration Act. Without a statutory instruction, the justices held that a court can look only to the application actually submitted to it in assessing its jurisdiction.
