One of the biggest misconceptions about trademarks is that every business should file one as soon as possible.

I don't believe that.

Every business has a limited legal budget. Every dollar you spend on legal work is a dollar you can't spend on marketing, hiring, inventory, equipment, or growing the business itself.

That's why one of the first questions I ask every prospective client is:

"Where do you see this business in five years?"

The answer usually tells me whether a trademark application makes sense today.

I have clients who have operated successful businesses in the same city for years. They know their customers by name, have no plans to expand beyond their local market, and aren't selling products nationwide.

For those businesses, I may recommend spending their legal budget somewhere else first.

Maybe it's a better website.

Maybe it's hiring another employee.

Maybe it's investing in marketing.

Maybe it's simply proving that customers want what they're selling before investing in legal protection.

On the other hand, I also represent businesses that are preparing to open additional locations, launch products online, expand into new states, franchise, or build brands they eventually hope to sell.

For those businesses, a trademark often becomes one of the smartest investments they can make because the brand itself is becoming a valuable business asset.

There are also industries where timing matters much more. Clothing brands, for example, are incredibly competitive and brand-driven. In those businesses, protecting the name early often makes good business sense, even before the company has fully matured.

The point is simple: there isn't one answer for every business.

My job isn't to convince you to file a trademark.
